This Privacy Statement explains how Pressflex LLC ("Pressflex", "Racery", "We" or "Us") uses your information and applies to all users of the Racery Service available at our website, www.racery.com (the "Site") and through our Racery mobile applications (collectively, the "Service"). This Privacy Statement is incorporated in our Terms of Use. This page informs you of our policies regarding the collection, use, and disclosure of personal information when you use our Service and the choices you have associated with that data. We will ensure that all personal information disclosed by you and that is held by us will be: (i) processed lawfully, fairly, and in a transparent manner; (ii) collected for specified, explicit, and legitimate business purposes and not further processed in a manner that is incompatible with those legitimate business purposes; (iii) adequate, relevant and limited to what is necessary; (iv) kept in a form which permits identification of data subjects for no longer than is necessary; and (v) processed in a manner that ensures appropriate security of the personal information, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage.
We may modify this Privacy Statement from time to time in our sole discretion by posting such modifications to our Privacy Statement available through the Service. We will endeavor to notify you in the event of any material changes to this Privacy Statement, which may include notification by email reminders, notices on the Service or other reasonable means. We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this statement. Unless otherwise defined in this Privacy Statement, terms used in this Privacy Statement have the same meanings as in our Terms of Use, accessible from www.racery.com. By using the Service, you agree to the terms of this Privacy Statement. If you do not agree with the practices described in this Privacy Statement, you are not permitted and should not use the Service. Use of the Service after we have posted modifications to this Privacy Statement shall constitute your agreement to the modified Privacy Statement. The date of the current version of this Privacy Statement is set forth below.
Information Collection and Use We Collect:
We collect several different types of information for various purposes to provide and improve our Service to you.
Types of Data Collected
Personal Data: While registering for or using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you ("Personal Data"). Personally identifiable information may include but is not limited to: Name, preferred Nickname: You provide us with a first and last name when you join a Race or Team. You may provide other Personal Data when you create or update your Bio through the Service, interact with the Service by posting Race or Team updates, respond to our emails with race updates and comments, submit answers to our surveys, post comments or chat through our Service, contact customer support, or connect or link to the Service via your Social Networks.
Email Address: You provide us with your email address when you join a Race or a Team.
Mailing Address: You may also provide us with a mailing address when you register for some fundraiser or medal races.
Bio/Race Updates: You may voluntarily provide us with additional Personal Data in connection with your interaction with the Service including by completing or updating your Bio or posting Race updates. You may upload photographs, provide us with your location, describe your physical activities or efforts or other Personal Data.
Usage Data: We may also collect information on how the Service is accessed and used ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, unique device identifiers, mobile network information and information about interaction with the Service such as the pages of our Service that you visit, the time and date of your visit, the time spent on the Service and other diagnostic data.
Tracking & Cookies Data: In some jurisdictions, we are not permitted to send cookies to the browser without the prior consent of the affected user. In this case, we will seek such consent. This section assumes that either the use of cookies is not restricted by applicable law, or if it is restricted that you have expressly consented to the use of the cookies. We use cookies and similar tracking technologies to track the activity on our Service and hold certain information, including to remember your preferences and settings. Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze our Service. Use of Data
Pressflex LLC uses the collected data for the legitimate business purposes relating to the Service including:
- To provide, maintain and improve our Service
- To respond to your requests and questions
- To notify you about changes to our Service
- To allow you to participate in interactive features of our Service when you choose to do so
- To provide customer support
- To gather analysis or valuable information so that we can improve our Service
- To monitor the usage of our Service
- To detect, prevent and address technical issues
We may also use your information to communicate and provide additional information that may be of interest to you about Racery and Race Sponsors; and send you reminders, updates, marketing messages (including on behalf of Race Sponsors. We may use information regarding how you use the Service, including the type of races in which you participate, to deliver advertisements and content targeted to you.
We may aggregate, use and analyze non-personally identifying user information, including survey data, race histories and demographic information, to understand our users and improve the Service or create new products and services. We may also create and publish or sell market research papers and data based on such aggregate non-personally identifiable information. We also may use information collected as described in this Privacy Statement with your consent or as otherwise required or permitted by law.
Disclosure of Data:
In general, we will not sell, share, disclose or rent your Personal Data in ways other than disclosed in this statement.
Information you post to the Services, such as photographs, Race updates and comments, will be publicly available to visitors, other users of the Service participating in the Races or on your Teams. If you do not wish for other users to have access to or view such information, you should not post it through the Service. Information in your Bio is available to the public and all visitors to your race or the Service.
We may disclose your Personal Data: (i) to our service providers that work with us to provide the Service; (ii) in order to comply with legal orders, and government and law enforcement requests, and other applicable laws, rules or regulations; (iii) enforce our Terms; (iv) detect prevent or address fraud, security or technical issues ; and (v) as we deem reasonable or necessary to protect against or mitigate harm to the rights, property or safety of Racery, other users of the Service or third parties.
We may also share your Personal Data with Race Sponsors of Races you have joined or to which you have contributed. Your use of the Service and agreement to our Terms and this Privacy Statement constitutes your permission to share your email or other Personal Data with such Race Sponsors. We are not responsible for use of your information by such Race Sponsors, and you should review their own privacy policies before registering for a Race under a Race Sponsor. We may also disclose non-personally identifying information with Race Sponsors for their own analysis and research or to facilitate targeted content and ads and to analyze the effectiveness of those ads.
Email communication: Users of the Service may receive email communications, promotions and offers from us and Race Sponsors, which may include races in which you are participating and those you are not. By registering for the Service or participating in a Race, you agree to receive these email communications. If you wish to end your participation in a Race or remove your email address from our communications list, please contact us. If you wish to opt out of receiving offers directly from Race Sponsors, you can follow the opt-out instructions in the emails that they send you.
Third-party ad servers and payment providers may automatically collect non-personally identifying information about your visit to the Site and use of the Service. These companies may use non-personally identifiable information (e.g., click stream information, browser type, time and date, subject of advertisements clicked or scrolled over) during your visits to our Sites in order to provide improved service to you. These companies typically use a cookie or third party web beacon to collect this information. We are not responsible for third party cookies. You may manage how your browser handles cookies by adjusting its privacy and security settings. Racery has implemented the following Google Analytics Advertising features on our website and Apps: Demographics and Interest Reporting, Display Network Impression Reporting, and Remarketing. When you visit the site, a Google Analytics cookie may record demographics and interest data about you from your use of the website or App, or from cookies in your browser. You may opt out of this tracking by visiting https://tools.google.com/dlpage/gaoptout/ to install Google’s Opt-Out Browser Add-On. We may also send you personalized ads if you visit a website that is part of Google’s certified ad network based on interests and demographics data recorded by Google’s Advertising cookie. You may opt out of personalized advertising by visiting https://www.google.com/settings/ads.
Social Media Sites: We may have pages or other presence on various social networking sites or services, such as Facebook, Twitter, Instagram and the like ("Social Networks"). Information you post on or through such Social Networks will be subject to the policies of the Social Network. If you have linked your Racery account with any of your Social Networks, or if you registered with Racery through your Social Network, we may receive, access and use personal information on your Social Network in connection with the Service as permitted under your permission settings.
Links To Third Party Sites: Our Service may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
Corporate Events: If Racery is sold or acquired by a third party, your Personal Data may be included in the assets sold or transferred to the acquirer. In the event of a bankruptcy, insolvency or similar event, we may not be able to control how your Personal Data is treated, transferred or used.
Security Of Data: The security of your data is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.
"Do Not Track" Signals: We do not currently support Do Not Track ("DNT"). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.
Retention of Data: Pressflex LLC will retain your Personal Data only for as long as is necessary for the legitimate business purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. When we no longer need your Personal Data, we will use reasonable efforts to delete or destroy the information.
Pressflex LLC will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.
Location of Servers: We use third party service providers to store and process Personal Data in the United States and other countries. By providing your information and using the Website, you explicitly consent to the transfer, processing, and storage of your information in the United States. If you do not wish for us to transfer your personal information to the United States, please contact us using the information in the "Contact" section below.

EU/EEA Citizens

We are required by law to verify your identity prior to granting access to your data in order to protect your privacy and security.
California residents are entitled to ask us for a notice identifying the categories of personal information which we share with our affiliates and/or third parties for marketing purposes and providing contact information for such affiliates and/or third parties.
Exercising Your Rights

Children’s Privacy: The Service is not designed or intended for children under 13 years old. We will delete information associated with any account if we have actual knowledge that the account is associated with a user who is not at least thirteen years old.
